Abstract:
This research critically examines the role of the International Criminal Court (ICC) in
addressing allegations of genocide in Palestine, focusing on its legal framework,
jurisdictional challenges, and geopolitical obstacles. Through a analytical approach, it
analyzes international treaties, such as the Rome Statute and Genocide Convention,
alongside case studies and scholarly perspectives. The study highlights the ICC's limited
enforcement capabilities due to contested statehood and political resistance, yet
underscores its potential for advancing accountability and justice through innovative
strategies. Recommendations include leveraging technology, strengthening international
cooperation, and enhancing jurisdictional flexibility to overcome these challenges and
safeguard human rights in politically sensitive regions like Palestine.
