Abstract:
A potent weapon for bringing about social change, public interest litigation (PIL) enables
people to pursue justice and defend the interests of society as a whole. Analysis takes into
account previous court decisions, historical viewpoints, and current difficulties in identifying
and resolving public nuisances through PIL. The capacity of PIL to deal with public nuisances’
activities that are detrimental to the community as a whole is one of its most important features.
Any action or inaction that infringes upon the rights and interests of the broader public is
considered a public nuisance. It includes a broad variety of problems including noise pollution,
encroachment into public areas, contamination of the environment, and health risks. PIL gives
individuals or groups the ability to file such cases in court on behalf of impacted communities.
there are challenges associated with the scope of PIL in addressing public nuisances. PILs are
a useful tool for resolving public nuisances because they encourage social fairness and
accountability, but their use must be carefully considered in relation to other competing
interests. PIL enables individuals or groups to bring legal action on behalf of the general public
in cases when collective rights are violated. It gives people the power to hold government
officials responsible for their deeds or inactions that worsen public nuisances. PIL contributes
significantly to preserving democracy and ensuring that justice is served by doing this.
