Abstract:
This study explores the relevant case laws and constitutional framework that control
Bangladesh's arrest and detention procedures. It examines how to strike a balance
between the need for law enforcement and the protection of citizens' rights by
analyzing constitutional provisions pertaining to individual liberties and due process.
The study looks at significant case laws that have influenced the laws pertaining to
arrests and detentions, providing insight into how judges have interpreted the law and
how it has changed over time. This study attempts to contribute to a more nuanced
understanding of the legal parameters surrounding arrest and detention in Bangladesh
by analyzing the intersection of constitutional principles and practical applications in
that country.
