Abstract:
Arbitrary arrest, detention, and death in custody continue to be chronic aspects of the criminal justice system in Bangladesh. Despite the fact that there are statutory and constitutional protections for the liberty and security of citizens, there are numerous charges of exploitation or abuse of the laws' provisions governing arrest and detention. This essay clarifies Bangladesh's legal framework for preventing arbitrary detention and arrest as well as judicial interpretation of these rules. Although Bangladesh's top court has taken a proactive approach to protecting people's rights to personal liberty by issuing directives and rulings prohibiting arbitrary detention and arrest, these remain largely ineffective as a result of the absence of law reform and noncompliance by law enforcement
