The Laws and Remedies for Road Accidence Victims in Bangladesh: An Analysis

Abstract

Road accidents in Bangladesh have become a pressing public health concern, claiming countless lives and causing severe injuries. This research paper examines the legal framework in place to protect the rights of road accident victims and assesses the effectiveness of available remedies. The primary legal instruments governing road accidents in Bangladesh are the Road Transport and Road Safety Act, 2018, the Bangladesh Penal Code, 1860, and the Motor Vehicles Ordinance, 1983. These laws provide for criminal penalties and civil remedies for victims. Road accident victims can seek compensation through civil suits and insurance claims. Additionally, criminal charges can be filed against those responsible for the accidents. However, accessing justice can be challenging due to factors such as weak enforcement of traffic laws, corruption, financial constraints, and lack of awareness among victims. To improve the protection of road accident victims, several recommendations are proposed. These include strengthening the enforcement of traffic laws, improving road infrastructure, enhancing the legal system, promoting awareness, and establishing a dedicated compensation fund. This research paper contributes to a better understanding of the legal framework and remedies available to road accident victims in Bangladesh. By identifying the challenges and limitations, as well as proposing potential solutions, this paper aims to inform policymakers and advocates working to improve road safety and the protection of victims' rights in Bangladesh.
