Protection of Intellectual Rights in Cyberspace: Scope and Challenges

Abstract

This research monograph examines the complexities and challenges involved in protecting intellectual property (IP) rights within cyberspace. The study highlights the importance of safeguarding intellectual property in the rapidly evolving digital landscape, addressing both national and international legal frameworks. This research monograph organized into four chapters. Chapter two provides a conceptual overview of intellectual property in cyberspace. Chapter three explores the national and international legal frameworks for IPR protection. Chapter four evaluates the effectiveness of existing National And International laws, a significant part of this chapter involves an analysis of practical insights gathered from a survey of 20 participants, who were questioned on four key grounds: familiarity with IP rights in cyberspace, types of IP owned in cyberspace, experiences with IP violations, and their support for stricter IP laws. The survey results offer valuable insights into the practical challenges and perceptions surrounding IP protection in cyberspace. The findings reveal a need for increased awareness, stronger enforcement mechanisms, and more stringent international cooperation to address the evolving threats to intellectual property in the digital space. This research underscores the necessity for comprehensive reforms in both national and international legal frameworks to better address the dynamic nature of cyberspace and its associated intellectual property risks.
